In a bizarre twist, all charges have been dropped against the men who police believe brutally attacked a former NASCAR driver and his daughter outside a country concert.
A veteran of the track and brother of NASCAR hall-of-famer Rusty Wallace, Mike Wallace and his daughter Lindsay Wallace Van Wingerden, were brutally beaten during an altercation with three men outside PNC Pavilion in Charlotte, North Carolina in June 2016.
Wallace sustained a significant number of minor injuries including a broken tooth, lacerations across his face, mouth, and lips, as well as damage to his eyes. His daughter fared better, suffering only a broken wrist and a black eye during the incident.
Following the beating, Wallace opened up about his story to the public and did several interviews spreading the word of the horrific act against he and his daughter. Three arrests were made and the case proceeded to trial in October. Due to an inadvertent error, witnesses were permitted in the courtroom and heard testimony forcing the judge to declare a re-trial last fall.
Now, in a seemingly bizarre twist, all charges against the three men have been dropped, but it wasn’t the judge or the police who requested to dismiss the charges…
According to a report by NBC Sports, Wallace and his daughter asked the district attorney to drop the charges against all three men. A court filing read that county prosecutor William Biggers stated, “In this case, the State is filing this dismissal based on the wishes of the victims.”
Wallace and his attorney have both declined to issue comment to any news source and his attorney stated that both of them would not be making a public comment on the matter.
While the criminal complaints brought against the three men have been dismissed, a civil lawsuit against them is still an option on the table for Wallace, but nothing has been filed as of today.
